Substation, located in Suez Governorate.

allow your company to quote for the above Project, we send you the following

1.
- GENERAL
The Tenderer is
to consider that he would participate in this project to the execution of the
works detailed herein as a Subcontractor fully responsible for the technical
quality of works, guarantees, time schedule, and other obligations towards our
Client.
These inquiry documents define the extent of Works to be executed by the Tenderer if awarded the Subcontract

PREQUALIFICATION REQUIREMENTS FOR TENDERER
2.1 Technical Capability
The tender shall submit the company’s brochure/literature showing the organization,
fields of activities, and other information which demonstrate his capability and
experience as a contractor in the corresponding field. In particular, The tenderer shall, when applicable, attach a copy of his Quality Assurance
certificates valid at the date of the proposal.
The tenderer shall define the organization he would implement in order to perform
the Works within the time-limits herein defined in the most efficient manner,
with an indication of manpower chart, typical organization chart, supervisory and
management personnel.
2.2
Experience
Record
The
Tenderer must have been involved successfully within the last 10 (ten) years in
works of similar type, complexity, and magnitude within severe time limits.
The tender shall submit a complete list of the projects completed in the last ten
(10) years in
The tenderer shall also submit a list of all ongoing and awarded but not yet
started projects. Such a list shall include a summary description of the works,
the total value of each contract, the level of responsibility of the Tenderer,
the percentage still to be completed, and the estimated date of completion.
2.3
Construction
Equipment Capability
The tenderer shall provide a typical list of construction equipment that would be
required for the execution of the Works. At least part of the listed equipment
shall be owned by the Tenderer.
2.4
Financial
Capability
The tenderer shall be a firm, partnership, or company
Ÿ Duly organized,
existing and registered under the laws of his home country
Ÿ Having not been
suspended or black-listed by any government agency, both local and foreign, as
individual contractor or partnership or corporation or as a member of a joint
venture.
Ÿ Having no record of
unsatisfactory past performance (particularly non-compliance with contract
terms, plans, and specifications); no record of defective workmanship and
materials supplied, of abandonment of work and similar deficiencies,
Ÿ Able to supply a
down-payment bond and a performance bond issued by a bank acceptable
Ÿ Having no criminal or
civil case pending or finally decided against it involving non-payment of tax,
duty or undertaking with the government of any of his subdivisions or branches
including government-owned or controlled corporations, both local and foreign.
For the determination
of the Tenderer's financial capability, the Tenderer shall submit company’s
statements of assets and liability, income statements, statement of changes in
financial position including notes to financial statements for the last three
(3) years certified by an independent Certified Public Accountant in the home
country of the Tenderer.
The tenderer shall attach to his tender:
1.
Documents
indicating the persons who have signed for the Tenderer.
2.
Completed
signed & stamped BOQ.
3.
A soft
copy of the priced BOQ on Excel file. Any exceptions or reservations concerning
the BOQ items shall be noted separately in Form A. No modifications or omissions
whatsoever shall be introduced to the BOQ.

A

3.
TECHNICAL
INFORMATION
The tenderer shall include in his tender all technical supporting documents and
details, and in particular:
a) Standard
company literature for the material and/or services detailed under this
inquiry.
b) Any
deviations from the provisions of the technical and commercial requirements
detailed hereto.
c) Detailed
of fixed-site installation and main plant/equipment to be mobilized with
associated datasheets.
d) List
of main equipment (with their year of manufacture) owned by the Tenderer.
e) List
of exclusions and assumptions.
f) Time
required for mobilization and detail of equipment and personnel to be
mobilized, in order to comply with the above-referenced technical
specifications.
g) Detailed
time-schedule of planned operations in line with the Master Schedule provided
in aforesaid Construction Package document.
4. PRICES
All
prices will be quoted as follows according to the format defined under the
Construction Package, and shall be inclusive of all applicable taxes, duties
and statutory levies which shall be defined in detail.
Prices
will be detailed as:
4.1
Price for
Indirect Costs
They include any element of price not
included in the Direct Costs hereafter, such as:
- Mobilisation
and demobilization of personnel and equipment,
- Temporary
site facilities,
- Accommodation
and/or camp facilities for site management and staff
- Office
expenses,
- Service,
lifting, handling, and transport equipment and associated operators, as well as
all other equipment available on site for general-purpose during the
construction period, including for general services,
- Site
management, technical support, and structure (planning, procurement, quantity
surveyors, storage personnel, interpreters, etc. ...),
- Vehicles
for above,
- Overheads,
- Allowance
for risks and contingencies,
- Profit.
4.2 Price for
Direct Costs, according to the format defined under the technical documents, including:
- Direct
labor work,
- Direct
supervision,
- Materials
incorporated into the Works, except when provided free of charge to the
Subcontractor,
- Consumable
materials (including electrodes and welding rods)
- Specific
equipment not included in Indirect Costs here above, and associated operators,
- Hand
tools
- Subcontractors'
prices
The
"Total Direct Costs" will be calculated according to the Quantities
and Unit Prices indicated on the bill of quantities.
The
Unit Prices shall be fixed and firm for the duration of the Project and not
subject to adjustment in case of quantity variations.
5.
Contractual
Terms and Conditions
The
detailed Contractual Terms and Conditions will be issued at a later stage.
For
the purpose of the present offer, the Tenderer shall consider the following:
The proposal shall remain valid for a period of 180 days minimum from the limit
date of submittal.
Except for the prices of reinforcement steel
and cement it will be indicted according to the announcing local price before the contract
signing but the tenderer should submit unit price rates he uses basically
in his offer for both reinforcement
steel and cement.
5.2
Currency
Subcontract Payment Currency: Egyptian Pound
5.3 Terms of
Payment
Down-payment:
10% of
the Subcontract Price (Down-Payment)
shall be paid to the Subcontractor upon signature of the Subcontract
Such
down-payment shall be executed against the provision of the proper guarantees by
the Subcontractor (see below).
Progress Payments:
80% of
the Subcontract Price shall be paid to the Subcontractor as follows:
- Direct
Costs: according to the progress on-site on the basis of monthly progress certificates.
- Indirect
Costs: pro-rata the Direct Costs.
Retention Payment
10% of
the Subcontract Price (retention money) shall be paid to the Subcontractor at
the Take Over of the Plant, against a Warranty Period Bond of 5% of the
Subcontract Price.
5.4 Financial
Guarantees
Performance Bond:
The Tenderer shall include in
his proposal the costs associated with a performance bond of 10% of
the total Subcontract Price that he would have to provide if awarded the
Subcontract.
A
Parent Company Guarantee may also be requested.
Down-payment Bond:
The tenderer shall include in his proposal the costs associated with a bank
guarantee of 10%
of the total Subcontract Price that he would have to provide if awarded the
Subcontract, for securing the repayment of the down-payment.
5.5 Liquidated
Damages for delays
The
total of Liquidated Damages for delays shall be determined as per specification.
The
rules of application of such Liquidated Damages shall be detailed at a later
stage.
5.6 Taxes
As
mentioned in § 4
above.
5.7 CAR
Insurance
A
Construction/Erection “All Risks” and “Third Party Liability” insurance shall
be subscribed for the Project.
5.8 Other
Insurance
The tenderer shall include the cost of any other insurance that may be necessary for the execution of the Works and in compliance with applicable law such as, but not limited to, Workers Compensation, Employer’s Liability, insurance covering any construction tools and equipment leased from third parties and Automobile Liability insurance including all owned, non-owned, and hired
automotive equipment used in the performance of the Works.
5.9 Governing Law
The
Subcontract shall be governed and construed in accordance with the Law of the Egyptian Government.

The tender may be faxed as an advance copy to the above-mentioned persons only, provided
it is confirmed by mail or DHL or equivalent.
8.
EVALUATION
OF TENDERS
The tender will be evaluated not only from an
economical point of view, but also from a technical and organizational
viewpoints, considering also the capability of the Tenderer to perform the
Works within a very tight time schedule.
In that respect, we strongly invite the Tenderer to enhance and detail any element of his Tender which may contribute to increasing---- confidence in such the capability of the Tenderer to comply with the three simultaneous constraints of Budget / Time / Quality
8.1
Acceptance/Rejection
of Tender
------ reserves his right to reject or accept any tender and to reject all tenders, without incurring any liability to the affected tenderer(s) or any obligation to inform the Tenderer(s)
of the ground for such action taken by AREVA.
The decision of---- to accept or reject any tender will be final.
8.2 Tendering
Expenses
All
expenses relating to the participation in this inquiry and preparation of The tender shall be borne by the Tenderer.
9.
LAWS AND
REGULATIONS:
The tenderer shall ensure that his offer is in full compliance with all laws,
statutes and regulations are applicable for such works in

OBLIGATIONS
The tenderer is requested to acknowledge receipt of the enclosed Request for
Proposal and to indicate the name(s), address, reference telephone number and
fax details of the person(s) in charge of this tender.
All
documents shall be submitted in English.
The
documents constituting this inquiry file shall be treated as confidential by
the Tenderer, his employees, and sub-contractors. Their content shall not be
copied nor disclosed to third parties except where such disclosure maybe
necessary for the tender preparation, in which case the Tenderer shall transfer
the obligation of confidentiality to such third parties.
